Global Champions Design Our Mascots challenge (the “Competition”) – Terms and Conditions

1. Introduction

1.1 Any individual who enters the Competition by submitting a Design (as defined below) shall be referred to as a ”Participant” and any design submitted in connection with the Competition shall be referred to as a “Design”.

1.2 By entering the Competition the Participant shall be deemed to have accepted these Terms and Conditions.

1.3 The organiser of the Competition is Global Champions Tour BV(“GC”).

1.4 No fee is required to enter into the Competition.

1.5 The language of the Competition is English.

2. Closing Date

2.1 The Competition will open for the submission of Designs on 31 January and will close on 14 February 2023 at 23:59 CET (the “Closing Date”).

2.2 Designs received after the Closing Date will not be accepted.

2.3 Proof of submission of a Design is not proof of receipt of a Design.

2.4 The shortlisted Designs will be announced on 15 February 2023 and in accordance with Clause 5.1. GC may change or extend the shortlist voting phase at its sole discretion.

3. Entry details / Design submissions

3.1 The Competition is open to all individuals being natural persons, regardless of age, subject to the limitations set out below.

3.2 Participants under the age of 18 must have their parent’s or legal guardian’s permission to enter the Competition.

3.3 All Designs must be submitted through the following dedicated email address: mascot@globalchampionstour.com and must be attached as PDF or JPEG files. Designs which are delivered in any other format will be refused by GC and excluded from the Competition. 

Together with the Design, the Participant shall also submit the following details of Participant: (i) name and surname, (ii) address, (iii) phone number; (iv) email address, where he/she can be reached on, and, (v) if the Participant is under the age of 18, his/her parent’s or legal guardian’s written permission to enter the Competition.

3.4 The Design can be any form of visual representation such as, but not limited to, a drawing, painting, photograph or collage. 

3.5 GC reserves the right to examine the Design in order to confirm compliance with these Terms and Conditions. Should GC, in its sole discretion, decide that the Design is not compliant with these Terms and Conditions, it shall have the right to refuse the Design and the Design shall be excluded from the Competition.

3.6 Entries may be submitted in black and white or in colour. 

3.7 The Design, in its entirety, must be a single work of original material made by the Participant. By submitting the Design, each Participant represents, acknowledges, and warrants that: 

(a) He/she is the sole author of each submitted Design and that it is an original work; 

(b) He/she owns the copyright and any other intellectual property rights of each submitted Design;

(c) The Design does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity; 

(d) That no other party has any right, title, claim, or interest in the Design;

(e) He/she has obtained, prior to the submission of the Design, the permission of those pictured in the Design, if any, (or, where the Design shows any persons under 18, the consent of their parent or guardian) for the usage rights required in the section on licensing below and will indemnify GC against any claims made by any third parties in respect of such infringement; 

f) He/she has obtained the consent of the owner of any private property featured in a Design; 

(g) He/she has the right, authority and capacity to make any assignments or grant any licenses in relation to the submitted Design to GC as required by Section 7.2 below and that he/she has not licensed or disposed of any rights in the Design that would conflict with uses to be made in the licensing section below; and 

(h) He/she agrees to take part in any post-Competition publicity, documentary and/or interview.

3.8 Participants cannot submit a Design that already has been published elsewhere or has won a prize in any other competition.

3.9 GC reserves the right to verify the validity and originality of a Design and/or Participant (including the identity and address of a Participant) and to disqualify any Participant (i) who submits a Design that is not in accordance with these Terms and Conditions and/or (ii) who tampers with the entry process. Failure by GC to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Categories

4.1 The Competition consists of the following 2 (two) categories (each a “Category”): 

  1. LGCT Mascot: The Design with the highest number of “likes” 
  2. GCL Mascot: The Design with the highest number of “likes” 

5. Prizes and judging

5.1 After the Closing Date, a jury composed by representatives of GC (“Jury”) will decide and declare the shortlisted Designs for each Category from all submitted Designs. The decision of the Jury is final and not subject to appeal. GC may, but shall not be obliged to, publish a list with the shortlisted Designs and/or Participants. The shortlisted Designs will, ultimately, be posted on the official LGCT’s Instagram channel: @longinesglobalchampionstour and submitted for a vote by the fans (general public).

5.2 Only those fans with an Instagram profile will be able to vote by “liking” the shortlisted Design(s) of their choice. In order for the vote to be valid, the fans will be requested to first “follow” the official LGCT’s Instagram profile.

5.3 Once the voting phase is over, for each Category, the shortlisted Design with the highest number of “likes” from those posted in the official LGCT’s Instagram channel will be declared the winning Design.

5.4 All Participants will take part in a draw to win a GCTV annual subscription. There are two (2) subscriptions to be won. The two (2) winning Participants will be contacted via email with instructions on how to activate their subscription. 

5.5 The winning Participant in a Category will win a free trip to one of the 2023 Longines Global Champions Tour events, the event to be selected by GC. The trip includes return airfare (economy class), three (3) nights’ accommodation (including breakfast) in a preselected hotel (one room allocated for the winner and companion) and VIP event tickets for 2 days for the winning Participant and one (1) companion (if the winning Participant is a minor then the companion must be his/her legal guardian). In addition, GC will use the winning Design as the basis/inspiration for the production of one (1) of the mascots present at GC events. 

5.8 Should the winning Participant, for any reason, not be able to attend the event selected by GC, GC reserves the right to award the prize to another Participant on a merit-based criteria, always to GC’s sole discretion.

5.9 There may be variations in the final design produced by GC for the mascot from the winning Design in order to accommodate production and/or legal requirements. GC reserves the right, at their sole discretion, to decide whether the mascot is finally produced or not. 

5.10 The winning Participants will be contacted shortly after the voting phase is over by email via the email address provided for confirmation of their identity. Furthermore, the winning Participants will be informed of the following steps to be taken with regard to the next phases of the Competition. If there is no answer within 48 hours of the email having been sent, GC reserves the right to declare a new winner for the relevant Category. 

5.11 The winning Participants release GC from any responsibility or liability in case, for any reason, (i) the mascot is not produced, (ii) the mascot produced does not look exactly the same or is not similar to the winning Design.

5.12 By participating in the Competition and accepting the prize mentioned in Clause 5.4 respectively 5.5 (the “Prizes”), the winning Participants agree to participate in some activities (i.e. interviews, promotional videos, etc) with GC for content creation purposes related to the Competition and/or the event preselected by GC and which he/she attends. 

5.13 The value of the Prizes cannot be exchanged for any other form of compensation.

6. Participants’ responsibilities

6.1 Each Participant is responsible for informing GC of any changes to the information entered, in particular of any change of the contact details.

6.2 Participants shall not submit any Design that can be considered obscene, vulgar, pornographic, hateful, threatening, racist, sexist, discriminatory, or which otherwise violate any national or international laws. No nudity is allowed. Children and babies must be wearing at least a nappy and, if a Design does feature a picture showing children under the age of 18, the Participant must have obtained the legal consent of the parents’/guardian(s)’ of the children shown for the Design to be published. GC will ultimately decide, in its sole discretion, if a Design is appropriate or not and whether it is eligible to be entered into the Competition.

7. License, copyright and usage

7.1 By entering into the Competition, each Participant shall be deemed to have granted GC a non-exclusive, perpetual, worldwide, irrevocable license to reproduce, enlarge, publish, exhibit or create derivative works, on any media (now or hereafter known) and in whatever forum GC may choose, with respect to the Design he/she has submitted. This may include, but is not limited to: 

News coverage of the Competition; 

GC website; 

GC social media, including but not limited to Facebook, Twitter, Instagram, TikTok, etc; 

Exhibitions; 

Publications – such as leaflets, calendars and reports; and 

Press releases to be distributed to international, national, regional and specialist press giving information about or promoting the Competition.

7.2 GC reserves the right to request each winning Participant to sign and return, within a specified period following notification, a legally binding written confirmation (in a form to be provided by GC) in which the Participant (i) warrants that he/she is the owner of the Design (and all the (intellectual property) rights in the Design submitted) and (ii) grants to GC and their licensees the irrevocable, perpetual, worldwide non-exclusive license to reproduce, distribute, display, and create derivative works of the Design (along with a name credit) in connection with the Competition and promotion of the Competition without additional compensation. Failure to execute and deliver any required documents GC by the specified deadline may result in disqualification from the Competition and selection of an alternate winning Participant.

7.3 Subject to Section 7.2 above, each Participant will retain full copyright for their Design and, wherever possible, the Participant’s Design will be credited to the Participant.

7.4 Failure to publish a credit due to error or oversight shall not be deemed a breach of Section 7.3.

8. Limitation of Liability

8.1 By entering the Competition, all Participants agree to release, discharge, and hold harmless GC and their partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Competition or any Competition-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

8.2 Neither GC nor partners assumes any responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorised access to Competition entries or entry forms; or alteration of entries or entry forms. Neither GC nor partners is responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials related to in this Competition.

9. Personal Data

9.1 Participants agree that personal data, especially names and addresses, may be processed, shared, and otherwise used for the purposes and within the context of the Competition and any other purposes outlined in these Terms and Conditions.

9.2 The data submitted by the Participant may also be used by GC in order to verify the Participant’s identity, postal address, and telephone number or to otherwise verify the Participant’s eligibility to participate in the Competition. 

10. Right to Cancel or Suspend the Competition

10.1 GC reserves the right, at its sole discretion, to disqualify any Participants who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Competition for any reason such as, for example, if for any reason the Competition is not capable of running as planned, due to infection by computer viruses, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of GC that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Competition, 

10.2 If GC decide to cancel or terminate the Competition, they will not retain any rights in the submitted Designs.

11. Miscellaneous Conditions

11.1 By entering the Competition, Participants agree: 

(a) To be bound by these Terms and Conditions; 

(b) That the decisions of the Jury are final and binding with respect to all matters relating to the Competition; 

(c) That GC may use the winning Designs and each winning Participant’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Competition or future promotions without compensation or approval.

11.2 If any provision contained in these Terms and Conditions shall be prohibited by law or judged by a court to be unlawful, void or unenforceable, such provision shall, to the extend required, be severed from these Terms and Conditions and rendered ineffective as far as possible without modifying or affecting the validity or enforcement of the remaining provisions.

11.3 GC may at any time decide to change, cancel, amend, vary, delete, add to and/or otherwise alter the terms and conditions of entry, the prizes and/or any other part of the Competition. GC shall not be required to send a separate notification to each person who has and/or may enter the Competition.

11.4 These Terms and Conditions are governed by Dutch law. Any dispute in relation to these Terms and Conditions shall exclusively be submitted to the competent court Oost-Brabant, the Netherlands.
